NAMBA President
One of the benefits of NAMBA membership is the availability of insurance through
NAMBA's commercial insurance program. NAMBA's loss history and exemplary
safety performance have permitted the organization to cost-effectively provide that
benefit for many years with a policy that is second to none for organizations like ours.
The nature of insurance is that underwriters will only assume certain risks, and they
will set premiums based upon the level of risk that they are willing to insure. NAMBA
and its insurance underwriters have a mutual understanding where compliance with
NAMBA's safety rules is required in order to obtain the benefit of NAMBA’s
insurance programs - a benefit available for those members that are willing to abide by
the safety rules. For that reason, NAMBA has long advised its members that the
insurance is available "so long as the member is observing all the NAMBA safety
rules."
Earlier this year, the Board learned of an accident that happened several years ago
that resulted in a serious personal injury to a member who was not following the safety
rules. Two members were running their boats while standing in the water and neither
of them had a pit person. One of the members lost control of their boat and hit the
other member in the leg. If they would have been following the rules, this accident
probably would have never happened. After several years of deliberation, our
insurance company settled and paid out a $500,000 claim. Due to potential
repercussions from that incident to NAMBA's continued ability to cost-effectively
provide insurance to its members, Al Waters, Mark Grim and myself proactively took
the initiative to avoid jeopardizing this valuable benefit. With the renewal of our
insurance policy year approaching, the Executive Board retained legal counsel with
expertise in maritime and insurance law to assist us in developing documentation that
would reinforce the existing requirement that members must abide by the safety rules
in order to maintain additional insured status through NAMBA. With that said, a
NAMBA Rule Acknowledgment Form was introduced in July, which was intended to
be a non-controversial means of enforcing requirements that are already in place while
simultaneously achieving our goal of providing cost-effective insurance to the
membership.
